The short version
- RipNova is a collectibles app from VelaVia LLC. You can track everything you collect in one portfolio, trade with other Members, and buy Rip packs and Boxes. You must be 18 or older, or the age of majority where you live if that is higher.
- Install RipNova for Android only from the “Download for Android” button at velavia.io/ripnova/. The App installs outside Google Play. A Google Play listing will follow, and an iPhone app is planned.
- Values in the App are estimates based on multiple marketplaces and recent sales. They are not appraisals, offers or investment advice, and collectibles can lose value.
- There are two kinds of credits. Play credits are free, have no cash value, and their pulls never ship. Nova Credits (100 Nova Credits = US$1) are bought with real money in the in-App Shop. RipNova doesn’t pay out money: credits and sell-backs can’t be cashed out.
- Rip packs and Boxes are for adults 18+. Each pack’s and Box’s odds are listed in the App under Settings › Odds & how packs work. Odds come from a fixed, versioned table. A pull may be worth less than the credits you spent.
- After a Nova Credit pull, you choose: sell it back within 24 hours for 90% of its value in Nova Credits, or keep it and ask us to ship it. When you ask us to ship, we acquire that exact item and ship it to you for a shipping fee based on the item. There is no free shipping.
- Authentication is an opinion, not a guarantee. But if an item we deliver to you is counterfeit or materially not as described, you get at least a replacement or a full return of the Nova Credits that pull cost, plus a refund of its shipping fee. Trades between Members are between those Members. RipNova doesn’t hold or ship them.
- Once you accept these Terms in the App, most disputes go to individual arbitration instead of court, and class actions are waived. You can opt out within 30 days. California law applies (Section 30).
This summary is for convenience. The full text below controls.
1. Who we are and what these Terms cover
Version 1.2. Effective October 25, 2026. Last updated October 25, 2026.
RipNova is a product of VelaVia LLC, 2108 N St Ste N, Sacramento, CA 95816, USA. Email: contact@velavia.io. Website: https://velavia.io/ripnova/. This document: /ripnova/terms/.
1.1 The agreement. These Terms of Service (the “Terms”) are a binding agreement between you and VelaVia LLC (“VelaVia,” “we,” “us” or “our”). They cover RipNova, which means:
- the RipNova website at https://velavia.io/ripnova/ and its pages (the “Site”);
- the RipNova app, including the Android app and any later Google Play or iPhone version (the “App”);
- the RipNova servers and software the App connects to; and
- every feature, purchase and service offered through them.
1.2 How you agree. You accept these Terms when you download the App from the Site, install, open or use the App, create an account, or make a purchase. If you only browse the Site, these Terms apply to that use as far as the law allows. If you do not agree, do not download, install or use RipNova.
1.3 Accepting in the App. When you create an account, the App shows you these Terms and the Privacy Policy, with a link to each. It asks you to agree, either by checking a box that is not pre-checked or by tapping an “I agree” button. We may also show an acceptance step before a purchase or after a material change. We record each acceptance (your account, the date and time, the versions of these Terms and the Privacy Policy, and the App’s version and your device’s system, such as Android, where the App reports them) and rely on that record to show that you agreed.
Section 30 (arbitration and class-action waiver) applies to you only once you accept these Terms in the App. Downloading, installing or browsing binds you to the rest of these Terms, but does not by itself make Section 30 apply to you.
If you accepted earlier RipNova terms in the App before this version took effect, the dispute terms you accepted then keep applying to you until you accept this version in the App. Section 30.10 governs any later change to Section 30.
1.4 The general VelaVia Terms do not apply. VelaVia publishes general terms at velavia.io/terms.html for its other products and websites. Those general terms do not apply to RipNova. For RipNova, the complete agreement is these Terms, the documents listed in Section 1.5, any Additional Terms and any Official Rules. That includes how disputes are resolved.
1.5 Related documents. These documents are part of these Terms:
- Privacy Policy: /ripnova/privacy/
- Disclaimers: /ripnova/disclaimers/
- Rip Packs and Boxes: Transparency Standard: /ripnova/rip-standard/
- Community & Trading Guidelines: /ripnova/guidelines/
Where the Site or the App asks you to agree to the Privacy Policy, that means you acknowledge that you have read it. Nothing in these Terms or the Privacy Policy reduces the privacy rights the law gives you.
1.6 Which document wins. If documents conflict, this order applies:
- (a) Official Rules, for that promotion only;
- (b) Additional Terms, for the feature they cover only;
- (c) these Terms; and
- (d) the other documents listed in Section 1.5.
Additional Terms and Official Rules may add detail. They may not reduce your rights under Sections 10.1, 12, 13.3, 14.2, 15.4, 18.6, 27 (the title warranty), 28 (the exceptions to the limits) or 30.7 to 30.10. They can change Section 30 only through Section 30.10, or where the law requires a different dispute process for a particular promotion.
1.7 IMPORTANT NOTICE ABOUT DISPUTES. SECTION 30 CONTAINS AN AGREEMENT TO RESOLVE DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION INSTEAD OF IN COURT, AND A WAIVER OF CLASS, COLLECTIVE AND REPRESENTATIVE ACTIONS. IT APPLIES ONCE YOU ACCEPT THESE TERMS IN THE APP. YOU MAY OPT OUT WITHIN 30 DAYS AS EXPLAINED IN SECTION 30.9. PLEASE READ IT CAREFULLY.
2. Definitions
These words have the following meanings in these Terms:
- “Member” means a person who has created a RipNova account. “You” means you, whether or not you are a Member.
- “Collectibles” means trading cards, graded slabs, sealed product, watches, sneakers, jewelry, comics, coins, cars, handbags and any other collectible items RipNova supports.
- “Slab” means a Collectible that a third-party grading service has graded and sealed in a holder.
- “Rip pack” means a pack of trading cards (Pokémon, Magic: The Gathering or Yu-Gi-Oh!) opened in the App. Pack names and art, such as Spark, Comet, Nova or Grail, are RipNova’s own. “Box” means a box of other Collectibles, such as watches, sneakers, comics, games or toys, opened in the App. Packs and Boxes come in the tiers shown in the App.
- “Play credits” means the free in-App credits described in Section 12.1. “Nova Credits” means the credits you buy in the in-App Shop, described in Section 12.2. “Free Nova Credits” means Nova Credits we give you for free, such as a package bonus or first-purchase bonus (Section 12.3).
- “Pull” means the specific item that a Rip pack or Box gives you when you open it: one identified product, such as a card’s name, set, number and condition or grade, or a product’s brand, model and reference. A pull is never points, tokens or a share of an item. A “play-credit pull” is one opened with play credits; a “Nova Credit pull” is one opened with Nova Credits.
- “Odds” means the published odds table for a pack or Box, which the App lists under Settings › Odds & how packs work (Section 10.3).
- “Sell-back” means returning a pull to VelaVia for credits, as shown in the App (Section 11.3).
- “Authentication” means a check, by VelaVia or an authentication partner, of whether an item appears genuine and as described. It is an opinion, not a guarantee (Section 14).
- “Your Content” means anything you submit to RipNova. That includes your handle and display name, profile showcases, photos and scans, collection data, condition notes, prices paid, binders, wishlists, imported files, offers, chat messages, receipt confirmations, logged trades, reviews, likes and feedback.
- “Additional Terms” means extra terms we show you, and that you accept, before you use a particular feature. They include the Fee Schedule, which is the list of RipNova fees published in the App or on the Site.
- “Official Rules” means written rules for a sweepstakes, contest or other promotion, published before it starts.
- “Including” means “including without limitation.”
3. Eligibility
3.1 Age. You must be at least 18 years old to download, install or use RipNova. If the age of majority where you live is higher, you must be at least that age (for example, 19 in Alabama and Nebraska and 21 in Mississippi). RipNova is intended only for adults and is not directed to children, even though it features Pokémon cards. Do not let anyone under that age use RipNova on your device or with your payment method.
3.2 Age confirmation and checks. When you create an account, the App asks you to enter your date of birth or to confirm, in a box that is not pre-checked, that you meet the age requirement. You cannot create an account or buy anything without completing this step. To buy Nova Credits you also need a verified account (Section 5.3). We may ask for proof of your age or identity at any time, and we may refuse or cancel a purchase, a shipment or an account if you can’t provide it. Rip packs and Boxes may require a higher age where the law requires it.
3.3 Location and sanctions. RipNova is aimed first at users in the United States. We ship only to US addresses (Section 13.2). We may limit any feature by country, state or province, including where the law requires it. You may not use RipNova if:
- you are located in, or ordinarily live in, a country or region subject to comprehensive U.S. sanctions or embargoes; or
- you are on the U.S. Treasury Department’s Specially Designated Nationals list or any other U.S. list of restricted parties, or you are owned or controlled by someone who is.
3.4 One account. You may have only one account. You may not create one if we have banned you. You may not use automation, VPNs, proxies or location spoofing to get around eligibility or location limits.
3.5 Using RipNova for a business. If you use RipNova on behalf of a business, you confirm that you are authorized to accept these Terms for it, and “you” includes that business.
3.6 Proof of eligibility. We may ask at any time for reasonable proof of your age, identity or location. If we reasonably believe you are not eligible, we may suspend or close your account. If we learn that an account belongs to someone under 18, we will close it, handle any purchases, Nova Credits, Nova Credit pulls and refunds as the law requires, delete that person’s personal information as the Privacy Policy describes, and delete or de-identify their reviews and trade records.
4. Getting and installing the App
4.1 Where to get RipNova. The Android App is available as a direct download from the “Download for Android” button at https://velavia.io/ripnova/. It installs outside Google Play. A Google Play listing will follow, and an iPhone app is planned. The App is free to download. Purchases inside it are covered by Sections 10 and 15. We may limit, pause or stop offering any download.
4.2 Official sources only. The only official sources of the App are:
- https://velavia.io/ripnova/, including any download page on velavia.io that we link you to; and
- once available, RipNova’s official listing on Google Play (or, for iPhone, Apple’s App Store).
Do not install RipNova from anywhere else, even if someone says the copy is official. That includes other websites, app mirrors, file-sharing services, messages and attachments. We never attach App files to emails or messages. Where the Site shows a SHA-256 fingerprint for the download, compare it with the file you downloaded, and do not install the file if they do not match. We are not responsible for any copy of the App from another source or any modified copy, and distributing or using one breaks Section 21.2.
4.3 Updates and signature warnings. Android may refuse to install an update over your App because the signatures do not match. That can mean the file is not an official update. Do not install it, and do not uninstall the App to get around the warning. Copies from velavia.io and from Google Play may not install over each other. Contact us before you switch, because uninstalling can affect access to your account (Section 5.3). We may require you to update, and older versions may stop working.
4.4 Installing outside Google Play. To install the App from velavia.io, Android asks you to let the app you downloaded it with, such as your browser, install unknown apps. This removes one of Android’s protections. You are responsible for your device’s security settings, and you may want to turn this setting off again after installing. When you install outside Google Play:
- Google has not reviewed that copy;
- Android or Google Play Protect may show warnings; and
- updates may not install automatically. Get new versions only from velavia.io.
VelaVia is not responsible for harm caused by other apps you allow onto your device.
4.5 Device permissions. The App asks for camera access only when you choose to scan or to take a photo, such as your profile picture or a photo of an item you add, and it uses internet access to connect to our servers. To choose photos from your gallery, it uses your phone’s photo picker, which gives it only the photos you pick. If you turn on phone notifications, the App asks for permission to show them. Meetups do not use your location. You can turn permissions off in your Android settings, but scanning will not work without the camera. The Privacy Policy explains what the App handles. If a new version of the App needs a new permission, we will update the Privacy Policy before releasing it.
4.6 Features change. We may add, change, limit or remove features, including by device or location. Some features may need Additional Terms, which we will show you before you use them. Until you accept them, there is no contract for that feature. RipNova may sometimes be slow, interrupted or unavailable, including for maintenance. No change to a feature takes away Nova Credits you bought, or a Nova Credit pull you have asked us to ship (Sections 12 and 18.6).
5. Accounts, security and what others can see
5.1 Creating an account. To create an account, you choose a public handle and a display name, complete the age step (Section 3.2) and accept these Terms (Section 1.3). Your handle and display name must not:
- impersonate anyone, or use another person’s real name without permission;
- suggest a connection to VelaVia, Pokémon, a grading company, a marketplace, or any brand, manufacturer or authentication service; or
- be offensive, misleading or infringing.
We may require you to change a handle or display name that breaks these rules, or change it ourselves.
5.2 Keeping your account secure. Protect your device with a screen lock, and do not share your sign-in details or the App’s data with anyone. You are responsible for activity, including purchases, on your account that you authorize or that results from your failure to take reasonable care of your device and sign-in. If you believe your account has been compromised, tell us promptly at contact@velavia.io with your handle. We will act as quickly as we reasonably can.
5.3 Signing in and losing access. You can sign in with an email code or with Google. Signing in links your account to a sign-in method we can verify, so you can get back in on a new phone. To buy Nova Credits you need a verified account: signed in with email or Google, and with a mobile number confirmed by a code we text you. One mobile number, and one card or PayPal payer, per account. If you uninstall the App, clear its data, switch between a velavia.io install and a Google Play install, or reset or lose your device, and no sign-in method we can verify is linked to your account, we may be unable to restore it. Nova Credits you bought and Nova Credit pulls you are entitled to have shipped remain yours. Contact us, and we may ask for proof of identity, purchase records or other information before we restore access, ship items or pay you.
5.4 Proving an account is yours. Handles are public, so a handle alone does not prove an account is yours. Before we act on a request about an account, such as a deletion request, we may ask you to show that you control it from inside the App (for example, by changing your display name to a code we give you), or for other reasonable proof.
5.5 Verification. Before certain actions, such as buying Nova Credits, shipping or high-value trades, we may require identity, age, location, tax or ownership verification. If we use a third-party provider for this, the Privacy Policy will name it and what it collects before we do. Reputation badges are not identity verification (Section 9.9).
5.6 No transfers. Accounts are personal. You may not sell, transfer or share yours.
5.7 What other Members can see. Treat everything you enter in the App as visible to other Members unless the App tells you a field is private. This can include:
- your handle, display name, Public Profile and showcases;
- items in your collection, with their condition and flags (Keep, Never trade, For trade, For sale). Toys, non-sport cards and the other items you add in Collection › Items (such as watches, sneakers, comics, coins, bags, jewelry, cars and sealed product) are private unless you turn on Show on my profile for one. A toy’s photos stay private unless you also turn on Show photos too, and the photos of a non-sport card or another item are never shown to other Members. A shown toy, non-sport card or other item shows what it is (for another item, the brand or maker, name, series and number you typed and the details shown for its kind), its condition and how many you have, never its flags, what you paid, your estimate, your notes or a detail kept private, such as a car’s mileage;
- if you turn on meetups, that you meet up to trade, your meetup record and, to Members who have also turned on meetups, a rough distance band between your ZIP areas (never your ZIP code);
- your wants and haves, which RipNova uses for trade matching, suggested offers and offers;
- the fact that you own a particular item, where the App lists collectors who own it;
- reviews about you and your reputation badges; and
- where the App offers them, who you follow and who follows you, your likes and your feed activity.
Do not put personal information you want to keep private in anything others can see. That includes your home address, phone number, serial numbers, VINs, license plates and photos that show where you live or where your items are kept. Valuable collections can attract unwanted attention, so think about what you show publicly.
5.8 Notifications. The App shows notifications in its in-App inbox, for example about offers, messages, price alerts, follows and parcels. If you turn them on, the App also sends phone notifications; you can turn them off in Settings or in Android. Notifications may be late or missing. Do not rely on them for time-sensitive decisions. Check the App directly, including for the 24-hour sell-back window (Section 11.3).
5.9 Blocking. You can block a Member from sending you offers or messages. Blocking also cancels any meetups planned between you and hides the toys, non-sport cards and other items you each show from the other. Blocking does not delete content they have already sent, and it may not stop them seeing what is public. To report harassment or other serious conduct, email contact@velavia.io.
6. Collection and portfolio tools
6.1 Scanning. When you scan an item, the App sends the photo to our servers, which identify the item and show an estimated value. Where available, a result shows a confidence indicator and the closest alternatives. The scanner reads Pokémon, Magic: The Gathering and Yu-Gi-Oh! cards; for Magic and Yu-Gi-Oh! cards, you confirm each match. We do not promise any level of scan accuracy. Automated identification can be wrong, and the confidence indicator is an estimate, not a guarantee. Treat each result as a suggestion, and check details such as set, number, printing, variant, language, model, reference and size yourself. Lighting, glare, sleeves, holders and image quality all affect results. Do not include people, documents, license plates or other personal information in scan photos.
6.2 Tracking your collection. For each item, you can record what it is, the quantity, photos and notes, and:
- condition, which is your own judgment, not a grade. VelaVia does not check it;
- the price you paid, which is whatever you enter. We do not check it;
- for toys, non-sport cards and the other items you add, your own estimate of each one’s value, which is whatever you enter. It is not a market value or one of our estimates, VelaVia does not check it, and only you see it; and
- flags such as Keep, Never trade, For trade and For sale.
Binder, set and checklist progress is based on our catalog and on what you record. Our catalog may be incomplete or contain errors. The For sale flag on a card tells other Members you might sell it (the flags on a toy, a non-sport card or another item you add are never shown to other Members). It is not a listing, and RipNova does not process or take part in any sale (Section 9.6).
6.3 Portfolio, cost basis and gain. Portfolio value over time, cost basis, gain or loss and condition-adjusted values are calculated from the prices you enter and our estimates (Section 7). They are estimates, not appraisals, grades, or tax or accounting records. If you turn on Count my estimates in my total, your own estimates for toys, non-sport cards and the other items you add are added to your total, labelled as yours. The same applies to the App’s other tools, such as sales and realized gains, the grading tracker, the sealed tracker, set completion, the trade scorecard and pull luck: they use what you record and our estimates, and are for your information only.
6.4 Wishlists and price alerts. A maximum price on a wishlist is a note for you and for trade matching, not an offer to buy. If you share a wishlist link, anyone with the link can see it, including people who do not use the App, and we cannot recall copies others have seen. Price alerts are for information only. They may arrive late or not at all, may be based on out-of-date estimates, and never buy or sell anything for you.
6.5 CSV import. You can import a CSV file you choose, including exports from other collection apps. We are not affiliated with those apps. You must have the right to import the file. Imports may not match every field or item correctly, so review the result.
6.6 Grades. Grades are assigned only by the grading companies that issue them. Certificate lookups and graded values come from third parties and may be wrong or out of date. RipNova does not grade items. Any automated photo check in the App, such as a centering check, is an estimate of how a photo looks, not a grade or a prediction of one. Do not tell a trading partner or buyer that an item has, or is likely to get, a grade based on anything in RipNova.
6.7 Keep your own records. Keep your own copy of records that matter to you. We do not have to restore lost collection data. We do keep records of your purchases, Nova Credits, Nova Credit pulls and parcels, as Section 12 and the law require.
7. Estimated values
7.1 Where values come from. Values in the App are shown in U.S. dollars. They are estimates based on multiple marketplaces and recent sales. Different categories may use different market sources. Some items have no estimate, and updates can be missed or delayed. Values shown on the Site may be samples for illustration.
7.2 Limits of the estimates. Estimates:
- may be wrong, delayed or out of date;
- may combine several printings, variants or editions under one entry;
- may not reflect your item’s condition, grade, language, size, model, year or history. Condition-adjusted values are only approximate;
- do not include shipping, fees or taxes; and
- are approximate when converted between currencies.
7.3 What estimates are not. Estimated values, portfolio figures, gain or loss figures, trade comparisons and suggested balanced offers help you manage your collection. None of them is:
- an appraisal;
- a certification of condition, grade or authenticity;
- an offer by VelaVia to buy or sell anything (sell-back is separate and is shown in the App, Section 11.3); or
- a prediction of what an item will sell for.
We do not describe any estimate as an item’s “true” or “fair” value. Labels such as “balanced,” and percentage differences, only compare estimates. Values shown with a pack’s or Box’s odds are built from these estimates (Section 10.3).
7.4 Do not rely on them officially. Do not use RipNova estimates as an appraisal or official valuation for insurance, lending, tax, estate, legal or court purposes, or as statements to a buyer or trading partner. Any portfolio or insurance report the App offers summarizes your records and our estimates. It is not an appraisal, and your insurer decides what it accepts.
7.5 Report errors. Tell us about a wrong value or item at contact@velavia.io. See also the Disclaimers (/ripnova/disclaimers/).
8. Not financial, investment, legal or tax advice
Nothing in RipNova is financial, investment, legal or tax advice. That includes estimates, price history, portfolio figures, price alerts, trade matches, suggested offers, the odds and values shown for packs and Boxes, and sell-back amounts. VelaVia is not your financial adviser, broker or fiduciary.
RipNova does not offer Collectibles, Rip packs or Boxes as investments. Nothing in RipNova suggests that any item will hold or increase in value. Values can go down as well as up. Markets for Collectibles can be thin, and an item may be hard to sell at any price. Past prices do not predict future value. Buy packs and Boxes for the items and the experience, only with money you can afford to spend, and never to make money.
You are responsible for your own decisions about buying, selling, trading, grading or holding Collectibles, and for your own taxes and tax records. If you need advice, consult a qualified professional.
9. Trading between Members
9.1 Trades are between Members. Members can trade with each other through the App, and RipNova suggests matches. A trade is an agreement between the Members involved. VelaVia is not a party to it, an agent for either side or a guarantor.
9.2 How trading works.
- Matching. RipNova compares Members’ wants (wishlists) and haves (items flagged For trade) and suggests matches and a balanced offer. Matches and suggested offers are automated, may be incomplete or wrong, and are not advice.
- Offers. A Member sends an offer, which may include several items on each side. The other Member can accept, decline or send a counter-offer.
- In-trade chat. Members in a trade can message each other in the App.
- Agreement. When both Members accept the same terms, the App records the trade as agreed. That is a commitment between the two of you, not with VelaVia.
- Delivery. Members ship items to each other or meet in person, and each arranges and pays for their own shipping. Pulls tagged RipNova (play-credit pulls) can’t be traded to other Members. The App’s meetup planner can help you agree a time and a public place to meet (Section 9.7). RipNova does not ship, hold, inspect, insure or guarantee items in trades between Members, and holds no cards or money for them. This is separate from Nova Credit pulls, which VelaVia acquires and ships itself (Section 13).
- Confirming receipt. Items change owner in the App only when both Members confirm their items arrived. Confirm only after you have received and checked the items. A confirmation is an in-app record. VelaVia does not verify it, and it does not by itself decide legal ownership or settle a dispute.
9.3 Comparisons and suggested offers. Trade value comparisons and suggested offers use our estimates (Section 7). They do not mean a trade is fair. Decide for yourself whether a trade works for you.
9.4 Describe items honestly. Describe each item’s condition, grade, alterations, repairs, replacement parts and damage accurately, and provide real photos of the actual item when asked.
9.5 Offers and agreed trades. You may withdraw an offer until it is accepted, and offers may expire as shown in the App. Once a trade is agreed, do not back out unless the other Member agrees or you have a good reason, such as the other Member breaking these Terms, and tell them promptly in chat. If a trade stalls, message the other Member first, then report it to contact@velavia.io. We may close or correct the in-app record of a trade, but we do not have to.
9.6 Item-for-item trades; private sales happen outside RipNova. Trades in the App are item-for-item. You may not add cash or any other payment to an offer, counter-offer or logged trade, or ask anyone to pay money to RipNova or VelaVia, or through RipNova, for a trade. Where an item is flagged For sale, its owner and an interested Member may discuss a price in chat. Any sale is then a private sale between the two of you, arranged and paid for entirely outside RipNova, at your own risk. VelaVia is not a party to it, does not process the payment and offers no buyer protection. If we later support cash in trades or sales between Members, cash may be paid only through RipNova’s payment system, under Additional Terms.
9.7 Trading safely.
- Check the other Member’s reviews and profile, and ask for clear photos of the actual items.
- Consider starting with small trades.
- Use tracked shipping, insure valuable items and keep proof of postage and packaging.
- Share your address only with the Member you are trading with, and only what is needed.
- Meet in person only in a public place, such as a card show or store. Consider bringing someone, and inspect items before confirming receipt.
- The App’s meetup planner is only for Members 18 and older, only at busy public places, and only for cards the other Member listed, under the rules in Section 13 of the Guidelines. VelaVia offers the planner and suggests places, but does not attend or supervise meetups, check anyone’s ID, or check that a place is open or safe. Card shops listed in the App are not affiliated with VelaVia unless marked Partner.
- For high-value items such as watches and jewelry, consider an independent inspection. For vehicles, follow the title and registration rules where you live. RipNova does not transfer title to any vehicle.
- Be wary of anyone who asks you to pay a fee to RipNova or VelaVia, pressures you to pay before you see an item, sends outside links or asks to move the conversation off RipNova.
Report problems to contact@velavia.io with your handle, the other Member’s handle and what happened. See also the Community & Trading Guidelines (/ripnova/guidelines/).
9.8 In-trade chat. Messages are stored on our servers, including any shipping address you send. As the Privacy Policy describes, we may review messages when we investigate a report, to keep RipNova safe, to enforce these Terms or where the law requires. Do not send financial details or identity documents.
9.9 Reviews and reputation badges. After a trade, each Member may leave a review of the other. Reviews must be honest, based on your own experience of that trade, and free of personal information, threats or abuse. You may not offer or accept anything for a review, or review a trade that did not happen. Reputation badges are calculated automatically from trading history recorded in the App, including receipt confirmations and logged in-person trades that Members report and VelaVia does not verify. We may adjust or remove badges or reviews to correct errors or abuse, or under the Guidelines. Reviews and badges are not identity verification, and they do not guarantee how any Member will behave.
9.10 Logging in-person trades. You can log trades you made outside the App. A logged trade is a record you create. VelaVia does not verify it and is not a party to the trade. Log only real trades, accurately, and never to inflate reviews, badges or your history.
9.11 Our review of trades. We may flag, delay or cancel a trade that appears to involve fraud, coercion, account abuse or manipulation, or that breaks these Terms. We will tell both Members if we do.
9.12 Risk in trades between Members. For items shipped between Members, the sending Member bears the risk of loss until the carrier’s tracking shows delivery to the receiving Member’s address, or a signature was obtained where required. For in-person trades, each Member is responsible for inspecting items at the handover. This is a RipNova platform rule that we apply when we enforce these Terms and record or correct trades. It does not by itself give one Member legal rights against another (Section 33.7). VelaVia is not responsible for items lost, damaged or never sent or handed over in trades between Members.
9.13 Disputes between Members. Disputes between Members are between them. We may help, but we do not have to. You release VelaVia from claims arising out of disputes with other Members. This release does not cover claims arising from our own acts or omissions, including how we acquire and ship Nova Credit pulls and handle payments, and it never covers VelaVia’s gross negligence, fraud or willful misconduct.
10. Rip packs and Boxes
10.1 What they are. You can open Rip packs (trading cards) and Boxes (other Collectibles) in the App, with play credits or with Nova Credits, as each pack or Box shows (Section 12). Each pack or Box gives at least one pull. Every pull is a specific, real item at its estimated market value (Section 7). A play-credit pull is for fun: it stays in the App and never ships (Section 11.1). A Nova Credit pull can be shipped: if you keep it and ask us to ship it, we acquire that exact item and ship it to you (Section 13). VelaVia’s title warranty (Section 27.3) covers every item we ship to you.
10.2 Who can open. Packs and Boxes are only for adults 18 or older (or older where the law requires) and only where permitted by law. Nova Credit packs and Boxes are available only where the Shop is open to your account (Section 12.2). Packs priced at 200 Nova Credits ($2) or less open with free Nova Credits only. You must open packs for yourself, as the account holder. Do not open packs for, or on behalf of, anyone who is not eligible. Where you use RipNova through an app store, that store’s rules also apply (Section 25).
10.3 Odds. Each pack’s and Box’s odds are listed in the App under Settings › Odds & how packs work. Odds come from a published table that carries a version code. They are fixed and the same for everyone: they don’t change as other Members open packs, or as you open more or open them faster. When we change a table, its version changes. If the table changes before you confirm an opening, the opening is refused, nothing is charged, and you see the new odds. Values shown with the odds use our estimates (Section 7). Odds are not published on the Site; check them in the App before you open.
10.4 What the odds are not. The odds and values describe the pack or Box under its current table. They do not promise what you will receive, what any item will resell for, or the result of any one opening or series of openings. A pull may be worth less than the credits you spent, and the value of any item can fall after you receive it. No figure in RipNova is a promise of a return.
10.5 How pulls are determined. The Transparency Standard (/ripnova/rip-standard/) explains how odds tables are set and versioned and how pulls are determined. It is part of these Terms. Opening animations, and any choice of pack or Box you tap, are presentation only and do not change the odds.
10.6 When a pull becomes yours. When an opening is complete, its pull is recorded to your account, and you can use the choices in Section 11. For a Nova Credit pull, title to the physical item passes to you when we hand it to the carrier for delivery to you. Risk of loss passes as Section 13.7 says. If the purchase behind the Nova Credits is refunded or charged back, Sections 12.3 and 15.5 apply.
10.7 Photos and artwork. Pack and Box names and artwork, such as Spark, Comet, Nova or Grail, are RipNova’s own. Product photos show the item model, not the specific unit you will receive. An item we ship is new, or for cards in the listed condition or grade. The App identifies the specific item you pull.
10.8 Spend limits and breaks. Spend limits on buying Nova Credits are on from the start: by default, $250 in any 24 hours and $1,000 in any 30 days, and $250 in total in a new buyer’s first 7 days. You can lower a limit at once; a raise takes effect 24 hours after you ask. You can also take a break: a cool-off of 24 hours, 7 days or 30 days, or stop buying for 6 months, a year or permanently. A break can’t be shortened from the App, and only we can end a permanent one, on your written request. Find these under Limits & breaks in the App, or email contact@velavia.io and we will block purchases on your account as soon as reasonably possible.
10.9 Rules for packs and Boxes. You may not:
- misrepresent a pull, including its identity, grade or condition, or claim you pulled an item you did not;
- sell or offer shares in your openings, or run group buys, raffles or box breaks around them, on or through RipNova; or
- use bots, scripts or multiple accounts to open packs or buy Nova Credits.
11. After a pull: keep, sell back or ship
11.1 Play-credit pulls. A play-credit pull stays in your RipNova collection, tagged RipNova. It never ships, and it can’t be traded to other Members. You can sell it back for 100% of its shown value, paid in play credits.
11.2 Nova Credit pulls. After a Nova Credit pull, you can:
- sell it back within 24 hours of the opening (Section 11.3); or
- keep it and ask us to ship it to you (Section 13).
Some options may not be available for every item. The App shows what is available.
11.3 Sell-back of a Nova Credit pull. Within 24 hours of the opening, you can sell a Nova Credit pull back to VelaVia for 90% of its value as locked at the pull, paid in Nova Credits. Sell-back is optional. Before you confirm, the App shows the amount and the time left.
- Sell-back pays Nova Credits, not money.
- Once confirmed, a sell-back is final. If an amount was clearly shown in error, we may cancel the sell-back and return the pull to you.
- If you owe Nova Credits (Section 12.3), a sell-back pays that debt first.
11.4 Shipping. Section 13 explains how shipping works.
12. Play credits and Nova Credits
12.1 Play credits. Play credits are free. You get them in the App, for example through the Daily and Welcome credits and Get play credits, and adding them costs nothing. Play credits have no cash value. They can’t be bought, withdrawn, sold, sent to other Members or exchanged for money, Nova Credits or anything else. Play-credit pulls never ship and can’t be traded (Section 11.1). We may change how play credits are given, or end them.
12.2 Nova Credits. 100 Nova Credits = US$1. You buy Nova Credits in the in-App Shop, in packages of whole dollars, through our payment providers (Section 15.2). You use them to open Nova Credit packs and Boxes. Nova Credits are not money or a deposit, earn no interest, and can’t be sent to other Members. Purchased Nova Credits do not expire. Nova Credits can’t be cashed out or withdrawn (Section 15.6).
12.3 Free Nova Credits. We may give you free Nova Credits, for example a bonus with a package or a first-purchase bonus, as the Shop shows. Free Nova Credits are promotional, have no cash value, and can’t be withdrawn or sold for money. They are used before purchased Nova Credits, and they expire as the App shows (currently 30 days after we give them).
A purchase’s bonus is void if that purchase is refunded or charged back. Then:
- bonus Nova Credits from that purchase that you haven’t spent are removed;
- bonus Nova Credits you have already spent become Nova Credits owed. Your next purchased Nova Credits, or your sell-backs, pay them first; and
- a pull opened with that bonus can’t ship until the Nova Credits owed are paid.
A refund alone doesn’t freeze your Shop account for bonus credits owed. A chargeback does (Section 15.5).
12.4 Records. We keep records of your Nova Credit purchases, Nova Credits, Nova Credit pulls and parcels as financial records, as the Privacy Policy describes, including after you delete your account.
12.5 If RipNova or the Shop shuts down. We will give at least 60 days’ notice in the App, and by email where we have your address, unless a court order or law prevents it. During the notice period you can still use your Nova Credits and ask us to ship kept Nova Credit pulls, and we will ship, or handle under Section 13.5, every pull you ask us to ship. We will refund unspent purchased Nova Credits where the law requires it. Anyone who takes over RipNova must take on these obligations (Section 33.2).
13. Shipping and delivery
13.1 We acquire, then ship. When you keep a Nova Credit pull and ask us to ship it, we acquire that exact item, from the maker, a retailer or a marketplace, and ship it to you. Cards come to us first so we can inspect them. Boxed retail products may ship directly from the maker or retailer. Play-credit pulls never ship.
13.2 Your address. We ship only to US addresses in the 50 states and DC. You can save up to three. We don’t ship to APO, FPO or DPO military addresses or to US territories. PO boxes are accepted, and a parcel to a PO box ships by USPS only. You are responsible for giving a correct address. If a parcel comes back because the address was wrong or delivery was refused, we may charge the reshipping fee shown in the App.
13.3 The shipping fee. There is no free shipping. Before you pay, the App shows a quote for your parcel, based on what is in it:
- postage by shipping class (raw card, graded slab, graded comic, small, medium or large box, or oversize): the largest item sets the base, and each other item adds to it;
- handling per parcel (currently $1.99);
- insurance once the parcel’s value reaches $100 (1% of its value, at least $1); and
- Signature Confirmation once the parcel’s value reaches $750.
Parcels under $100 ship by USPS Ground Advantage; parcels of $100 or more ship by Priority Mail, insured. A quote holds for 30 minutes. You pay the shipping fee in U.S. dollars at the Shop’s checkout, by card, PayPal or Venmo.
13.4 When it ships. Most orders ship within 7 days of your request. Some take up to 3 weeks, depending on location and availability. You get a tracking number when it ships. If we can’t ship within 30 days of your request, we tell you, and you can choose to wait or to cancel for a full return of the Nova Credits the pull cost and a refund of the shipping fee.
13.5 Price lock, and if the item can’t be found. The value shown at your pull is the value we honour, even if the market price changes before we acquire the item. If the exact item is unavailable (for example discontinued, or not available anywhere at a fair price), we tell you and you choose: an equal-or-better item that we name, or a full return of the Nova Credits the pull cost. Either way, if you don’t take an item, we refund the shipping fee. We never substitute without your choice.
13.6 Holds. A parcel is put on hold, and isn’t packed or shipped, while your Shop account is frozen, while a payment dispute is open, or while you owe Nova Credits for a voided bonus (Sections 12.3 and 15.5).
13.7 Risk of loss. Risk passes to you when delivery is confirmed. That means the carrier’s tracking shows delivery to the address you gave us, or a signature was obtained where one is required. Until then, the parcel is our responsibility and we handle any claim with the carrier. If a parcel is lost or damaged before delivery is confirmed, we will replace the item with the same item in comparable condition where one is available or, at your choice, return the Nova Credits the pull cost and refund its shipping fee. This does not limit our liability for gross negligence, fraud or willful misconduct.
13.8 Problems on arrival. Report damage or a wrong item within 7 days of delivery, with photos, and keep the packaging. This does not shorten any time the law gives you, or the time for a counterfeit claim under Section 14.2.
13.9 Timing. Delivery times are estimates.
14. Authentication and grading
14.1 Authentication is an opinion. Where an item is authenticated, by VelaVia or by an authentication partner, authentication is an opinion formed with reasonable care. It is not a grade from any grading company, and it is not a guarantee that an item is genuine. We will not market any item as “guaranteed authentic.” The Transparency Standard and the Guidelines describe the standards we apply.
14.2 Our obligations as seller. Authentication being an opinion does not limit VelaVia’s obligations as the seller of any item we ship to you as a Nova Credit pull, including implied warranties and consumer-protection laws that cannot be waived. If an item we ship is counterfeit or materially not as described, you are entitled at minimum to a full return of the Nova Credits the pull cost and a refund of the shipping fee you paid for it, or, if you prefer and one is available, a genuine replacement. Where the law gives you more, you get it. To make a claim, email contact@velavia.io with your handle, the item and your evidence. We may ask you to send the item to us for review, at our cost for a valid claim, and we will decide in good faith and tell you why. This does not reduce the title warranty in Section 27.3 or the exceptions in Section 28.
14.3 Trades between Members. VelaVia does not authenticate items traded between Members unless the App expressly offers that service.
14.4 Grades. Any grade shown in RipNova is assigned by the grading company that issued it. RipNova does not grade items, and graded values are not endorsed by any grading company.
15. Payments, fees, refunds and taxes
15.1 Prices. Packs and Boxes are priced in credits. Nova Credit packages and shipping fees are shown in U.S. dollars before you confirm. If sales tax applies, it is shown before you pay. Fees are listed in the Fee Schedule.
15.2 Paying. Third-party payment providers process payments: today Stripe (cards) and PayPal (including Venmo). You may need to accept their terms. VelaVia does not store full card numbers. When you confirm a purchase, you authorize us and our payment providers to charge your payment method. You must be authorized to use that payment method.
15.3 Cancellations by us. We may refuse or cancel a purchase if we suspect fraud, you are not eligible, the price was clearly shown in error, or a technical error occurred. If we cancel, we refund you in full.
15.4 Refunds. Opening a pack or Box is final once it has been opened, except:
- duplicate or mistaken charges are refunded;
- if a technical problem interrupts an opening, we will make sure you receive the pull or, if we cannot, return the credits in full;
- an opening refused because the odds table changed charges nothing (Section 10.3);
- if an item we ship is counterfeit or materially not as described, Section 14.2 applies; and
- where the law gives you a right to a refund.
If a Nova Credit purchase is refunded, the Nova Credits from it and its bonus are removed. Any you have already spent become Nova Credits owed (Section 12.3), and spent purchased Nova Credits may freeze your Shop account until they are paid. Refunds go to your original payment method where possible and are limited to the amount you actually paid. No one is compensated for changes in market prices. Apart from the cases above, a Nova Credit purchase is final once the credits are added, unless the law requires a refund or we agree to one. If a purchase was a mistake or wasn’t made by you, contact us promptly.
15.5 Chargebacks. If you have a problem with a charge, contact us first, and we will try to fix it. While a dispute with your bank or card issuer is open, your parcels are on hold. If a chargeback goes against us, your Shop account is frozen: the Nova Credits from that purchase and its bonus are removed, any already spent become Nova Credits owed, and your parcels stay on hold until the matter is resolved.
15.6 Cash sell-back and withdrawals. RipNova does not pay out money. Play credits, Nova Credits, free Nova Credits and sell-backs can’t be cashed out or withdrawn. If we ever offer cash payouts, it will be under separate terms that you accept first.
15.7 Fee changes. We will give at least 30 days’ notice of any fee increase. A fee change never applies to a purchase or shipping request you confirmed before it took effect.
15.8 Subscriptions. If we ever offer a subscription, before you buy we will clearly show the price, how often you will be billed, that it renews automatically until you cancel, and how to cancel. We will ask for your express consent, send a confirmation, let you cancel online, remind you before renewals where the law requires, and give at least 30 days’ notice of any price increase.
15.9 Taxes. You are responsible for your own taxes, including on items you sell elsewhere. Where the law requires, we may collect sales tax, ask for your taxpayer information and issue tax forms.
16. Promotions
16.1 Official Rules. We run sweepstakes, contests or giveaways only under Official Rules published before they start. Official Rules will cover, at a minimum: the sponsor (VelaVia LLC), who is eligible, the entry period, a free method of entry with the same odds as any paid entry for any chance-based promotion, entry limits, each award and its approximate retail value, the odds, how recipients are selected, taxes, any releases, and any state registration or bonding. Official Rules apply California law and Sections 30 and 31, including the class-action waiver, unless they expressly say otherwise because the law requires it.
16.2 No entries for purchases. We do not award entries, points or status based on pack or Box purchases unless the law permits it and the Official Rules describe it.
16.3 Your own promotions. You may not run contests, giveaways, raffles or sweepstakes on or through RipNova, including in the feed, in chat or on your profile, unless VelaVia authorizes it in writing.
17. Prohibited items and conduct
17.1 Prohibited items. You may not list, offer in a trade, send to us or describe as genuine:
- counterfeit, reprinted, proxy or replica items, or fake slabs;
- tampered or re-holdered slabs, or franken or parts-swapped items;
- items with altered or removed serial numbers, hallmarks or certification;
- stolen items, or items you do not own;
- altered or restored items (for example trimmed, recolored or resealed) whose alteration you have not disclosed; or
- items whose sale is illegal.
17.2 Prohibited conduct. You may not:
- manipulate prices or activity, including faking trades, receipt confirmations, logged trades, reviews, follows or likes, gaming reputation badges, or trading between accounts you control;
- abuse accounts, including opening multiple accounts to avoid limits or bans, or selling, renting or sharing an account;
- misuse the App or our systems, including bots, scrapers, bulk-extracting catalog, price or profile data, reverse engineering (except as the law allows), modifying the App or distributing unofficial copies, accessing our servers other than through the official App, overloading RipNova, interfering with its security or probing for vulnerabilities without permission. Report security issues to contact@velavia.io;
- mistreat people, including harassment, hate speech, threats and spam, or collecting or sharing others’ personal information, or using what RipNova shows about other Members’ collections to target them;
- mislead people, including impersonating anyone, falsely claiming a connection to VelaVia, Pokémon, a grading company, a marketplace or any brand, manufacturer or authentication service, or presenting RipNova’s estimates, condition-adjusted values or badges as grades, appraisals or identity verification;
- misuse payments, including using a payment method you are not authorized to use, filing chargebacks in bad faith, adding cash to an in-app offer or logged trade, asking anyone to pay money to or through RipNova outside its payment system, or using chat or the For sale flag to defraud anyone; or
- break the law or our rules, including fraud, money laundering, sanctions evasion, buying packs or Boxes for anyone who is not eligible, running any game of chance, raffle or pool on or through RipNova, filing false claims or reports, or using VPNs or location spoofing to get around restrictions.
17.3 Your right to review us. Nothing in these Terms stops you from posting honest reviews of, or comments about, RipNova or VelaVia.
18. Enforcement, suspension and termination
18.1 How we enforce these Terms. We generally give a warning, then limit features temporarily, then suspend, then ban permanently. We may skip steps for serious conduct, such as fraud, counterfeits or threats, or where the law requires it. Where it is lawful and safe, we will tell you what we did and why.
18.2 Appeals. You may appeal within 30 days in the App (Account › Account status, once per decision) or by emailing contact@velavia.io with your handle. We aim to respond within 14 days. If we close an account because it belongs to someone under 18, it is deleted 3 days after we tell you, so email us before then; after that we can’t restore it, but we can release its handle. Where feasible, someone not involved in the original decision will review it.
18.3 Leaving RipNova and deleting your account. You may stop using RipNova at any time. Uninstalling the App does not by itself delete your account. To delete it, use the Delete account option in the App under Account › Settings (App version 0.3.9 and later), follow the instructions at https://velavia.io/ripnova/delete-account/, or email contact@velavia.io with your handle. We may ask you to confirm from inside the App (Section 5.4). If you have Nova Credit pulls you have asked us to ship, we will ship them, or follow Section 13.5, before your account is closed. Before you delete, use your Nova Credits and ask us to ship any kept pulls you want. If your account still has purchased Nova Credits or unshipped Nova Credit pulls, email us first and we will help. Deleting ends your access to any credits and pulls left on the account. Nova Credit shop records are kept as financial records, unlinked from your account. The Privacy Policy explains how deletion works and what we must keep.
18.4 When we may end your access. We may suspend or end your access if you break these Terms, there is a risk of fraud, the law requires it, or your conduct harms others.
18.5 Ending RipNova. We may stop offering RipNova or any part of it. Section 12.5 applies.
18.6 Your property after termination. However your access ends, Nova Credit pulls you asked us to ship before it ended will be shipped, or handled under Section 13.5, and refunds we owe you will be paid. We may keep holds the law allows, such as for a fraud investigation, a court order or a chargeback (Section 15.5). We will never take your property because your access ended. Ending your access does not by itself forfeit kept Nova Credit pulls or unspent purchased Nova Credits: we will ship kept pulls you ask for to your US address (the shipping fee applies) and refund unspent purchased Nova Credits, less amounts you owe us. The exceptions are the ones in Section 24 of the Community Guidelines, such as lawful holds, fraud, chargebacks and stolen or counterfeit items. Free Nova Credits and play credits end with your access.
18.7 Sections that survive. Sections 7, 8, 9.12, 9.13, 10.4, 10.6, 11.3, 12 to 15, 18.6, 19.4, 20 and 21 to 36 continue to apply after termination.
19. Your content
19.1 You keep ownership. You own Your Content.
19.2 The license you give us. You give VelaVia a worldwide, non-exclusive, royalty-free license to host, store, process, display, reproduce and adapt Your Content, only to operate, secure, improve and promote RipNova. That includes showing it to others where the App is designed to show it (Section 5.7). We may pass this license on to service providers who help us do those things. We will not use your name or likeness in advertising without your separate consent.
19.3 Your promises. You confirm that you have the rights needed to share Your Content and that it does not break the law or anyone else’s rights.
19.4 When the license ends. The license ends when you delete the content or your account, except for:
- backup copies, which we keep for up to 90 days;
- copies others have already seen or received, for example through your profile, the feed or a shared wishlist link;
- reviews and trade records we keep so that other Members’ histories stay accurate and so we can handle disputes (if we learn a Member is under 18, we delete or de-identify theirs instead); and
- content and records we must keep for legal reasons, including purchase, shipping and payment records.
19.5 Scan images. The App may resize or compress scan photos before sending them. The Privacy Policy explains what happens to scan images after identification and how long we keep them. Before we use scan images to train identification models, we will update the Privacy Policy, and we intend to let you opt out.
19.6 Moderation. We may remove content that breaks these Terms or the Guidelines, including handles, display names, showcases, reviews, feed items, logged trades and messages. We do not have to monitor content. Report abusive content or conduct to contact@velavia.io.
20. Feedback
If you send us ideas, suggestions or bug reports, we may use them without restriction and without paying you. We do not have to keep them confidential.
21. Our intellectual property and your license
21.1 What we own. VelaVia owns or licenses RipNova, including the Site, the App, our servers and software, their design and text, and the RipNova and VelaVia names and logos. Third-party data stays subject to its owners’ rights and licenses, and open-source components are covered by their own licenses.
21.2 Your license. Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable and revocable license to use RipNova for its intended purposes, including installing the App from an official source (Section 4.2) on devices you own or control. You may not:
- copy, re-host, mirror or distribute the App or any App file. To share RipNova, point people to the Site;
- modify, decompile or reverse engineer the App, except to the extent the law allows despite this restriction; or
- build or use unofficial apps, scripts or tools that access our servers.
21.3 Reservation. All rights we do not expressly grant are reserved.
22. Trademarks and non-affiliation
22.1 Pokémon, Magic: The Gathering and Yu-Gi-Oh!. RipNova is not affiliated with, endorsed, sponsored or approved by Nintendo, The Pokémon Company, Creatures or GAME FREAK. Pokémon and card names are trademarks of their respective owners. RipNova is not affiliated with, endorsed, sponsored or approved by Wizards of the Coast or Hasbro. Magic: The Gathering is a trademark of Wizards of the Coast LLC. RipNova is not affiliated with, endorsed, sponsored or approved by Konami. Yu-Gi-Oh! is a trademark of Konami or its licensors. RipNova’s packs use RipNova’s own names and artwork, not those of any card publisher.
22.2 Other brands. Brand names shown on the Site or in the App, such as Rolex, Nike, Air Jordan and The Royal Mint, are trademarks of their owners (including Rolex SA, Nike, Inc. and The Royal Mint Limited). RipNova and VelaVia LLC are not affiliated with, sponsored or endorsed by them.
22.3 No affiliation. RipNova and VelaVia LLC are also not affiliated with, sponsored or endorsed by:
- any grading company, such as PSA, CGC or Beckett;
- any marketplace or data source that market estimates draw on, or any collection app you import from;
- Google or Apple, except as their customer;
- the publishers of any other game we support;
- any manufacturer, publisher, league, team, player, players’ association, brand or other rights holder associated with any Collectible; or
- any other company, app, marketplace or grading service named on the Site or in the App.
22.4 Other marks. All other marks belong to their owners and are used only to identify products. Card images are shown to identify cards, and product photos illustrate the kinds of items described. All rights in them remain with their owners. See also the Disclaimers (/ripnova/disclaimers/).
23. Copyright and other rights complaints
23.1 Copyright notices. Send copyright notices to Attn: Copyright Agent, at contact@velavia.io or by mail to VelaVia LLC, 2108 N St Ste N, Sacramento, CA 95816, USA. A notice must include:
- your physical or electronic signature;
- identification of the copyrighted work;
- identification of the material you say infringes, and where it appears (for example, a URL, or a handle and where in the App);
- your contact details;
- a statement that you believe in good faith the use is not authorized; and
- a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner.
23.2 Counter-notices. If your material was removed and you believe that was a mistake, send a counter-notice with your signature; identification of the removed material and where it appeared; a statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification; your name, address and phone number; your consent to the jurisdiction of the federal district court for your address (or, outside the U.S., any judicial district where VelaVia may be found); and your agreement to accept service from the person who sent the original notice. We will restore the material within 10 to 14 business days unless that person tells us they have filed a lawsuit.
23.3 Repeat infringers. We will close the accounts of Members who repeatedly infringe.
23.4 Trademark, counterfeit and other complaints. If you believe content on RipNova infringes your trademark or another right, or offers counterfeit goods, email contact@velavia.io with the subject line “RipNova IP Complaint.” Include your contact details, the mark or right concerned, where the material appears, and a good-faith statement that the use is unauthorized. We may remove the material and notify the affected Member, giving them a chance to respond, and may suspend repeat offenders under Section 18.
24. Third-party services and links
RipNova relies on third parties, including:
- a cloud hosting provider, which processes App data on our behalf;
- web analytics on the Site, configured for measurement only with advertising features turned off, and web fonts. The Site does not use advertising networks;
- payment providers, and identity, age and location verification providers;
- authentication partners, the makers, retailers and marketplaces we acquire items from, and shipping carriers;
- multiple market sources for estimated values;
- app stores, once RipNova is listed there (Section 25); and
- our email provider.
The Privacy Policy explains what each kind of provider receives. Where the law requires your consent for analytics, we will ask for it. We are not responsible for third-party websites or services we link to, or for their terms.
25. App stores
25.1 Direct download and app stores. Today, the Android App is downloaded from velavia.io and installed outside Google Play (Section 4). A Google Play listing will follow, and an iPhone app is planned. Google and Apple are not parties to these Terms, and they are not responsible for the App when you get it from velavia.io.
25.2 Apple. If you download RipNova from Apple’s App Store:
- your license is limited to Apple-branded products you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions, and other accounts associated with you may access the App through Family Sharing or volume purchasing;
- these Terms are between you and VelaVia, not Apple, and VelaVia alone is responsible for the App;
- Apple has no obligation to provide maintenance or support;
- if the App fails to meet a warranty that applies to it, you may tell Apple, and Apple will refund the purchase price of the App, if any. Apple has no other warranty obligation for the App;
- Apple is not responsible for any claims about the App, including product liability, legal compliance, consumer protection or third-party intellectual property claims;
- you must comply with any third-party terms that apply when you use the App;
- send questions, complaints or claims about the App to VelaVia (Section 35); and
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
25.3 Google Play. If you get the App through Google Play, Google Play’s terms also apply to your download. These Terms are between you and VelaVia, not Google, and VelaVia alone is responsible for the App.
25.4 App store purchases. Purchases made through an app store’s billing system follow that store’s billing and refund rules.
26. Communications and electronic notices
26.1 Email. If you give us an email address or email us, we use it to send receipts and service messages and to respond to you, as the Privacy Policy describes. If we send marketing emails, each includes an unsubscribe link and our postal address, and we act on unsubscribe requests within 10 business days. We do not sell email addresses or share them for cross-context behavioral advertising.
26.2 Notifications and texts. Notifications appear in the App’s inbox. Phone notifications are optional: the App asks before turning them on, and you can turn them off in Settings or in Android. When you confirm a mobile number, we text you a one-time code at your request; message and data rates may apply. If we add other text messages, we will ask for your separate express consent, which will never be a condition of a purchase, and we will explain how to reply STOP or HELP, how often we will message you and that carrier rates may apply.
26.3 Electronic notices. You agree that we may give you notices about RipNova electronically: in the App, by posting on the Site, or by email to the most recent address you gave us. To the extent permitted by law, these satisfy any requirement for written notice. Where the law requires separate consent for a particular electronic disclosure, we will ask first. An email notice counts as given when sent, and a notice in the App or on the Site when posted. Notices to VelaVia must go to contact@velavia.io or to the address in Section 35, and count as given when we receive them.
27. Disclaimer of warranties
27.1 TO THE EXTENT PERMITTED BY LAW, RIPNOVA, THE SITE, THE APP, OUR SERVERS AND ALL CONTENT, DATA, ESTIMATES AND FEATURES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” VELAVIA DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND, FOR SOFTWARE, DATA AND CONTENT ONLY, TITLE.
27.2 VELAVIA DOES NOT WARRANT:
- THAT RIPNOVA WILL BE AVAILABLE, ACCURATE, SECURE, UNINTERRUPTED OR ERROR-FREE;
- THE ACCURACY OF ANY SCAN RESULT, CONFIDENCE INDICATOR, TRADE MATCH, SUGGESTED OFFER, ESTIMATE OR VALUE;
- THAT YOUR COLLECTION DATA WILL BE PRESERVED, OR THAT THE APP WILL WORK ON YOUR DEVICE;
- THE VALUE OR RESALE PRICE OF ANY ITEM, INCLUDING ANY PULL;
- HOW ANY MEMBER WILL BEHAVE, OR THE ACCURACY OF ANY RECEIPT CONFIRMATION, LOGGED TRADE, REVIEW OR BADGE; OR
- THE CONDITION, AUTHENTICITY OR DELIVERY OF ANY ITEM TRADED OR SOLD BETWEEN MEMBERS.
27.3 Items we sell, and the title warranty. This disclaimer does not apply to physical items VelaVia itself ships to you as Nova Credit pulls, to the extent the law gives you warranties that cannot be waived, and it does not limit Section 14.2. VelaVia warrants that it has good title to, and the right to transfer, every item it sells or ships to you, including every Nova Credit pull it acquires and ships to you. This warranty does not cover items that you or another Member owned before VelaVia handled them.
Some places do not allow these exclusions, so some may not apply to you, and you may have additional rights. See also the New Jersey notice in Section 28.
28. Limitation of liability
TO THE EXTENT PERMITTED BY LAW:
- (A) VELAVIA IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE OR DATA.
- (B) VELAVIA’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO RIPNOVA IS LIMITED TO THE GREATER OF US$100 OR THE AMOUNTS YOU PAID VELAVIA (INCLUDING PURCHASE PRICES AND FEES) FOR RIPNOVA IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
These limits do not apply to:
- liability for gross negligence, fraud or willful misconduct;
- death or personal injury;
- our obligations to ship, replace or return the Nova Credits for Nova Credit pulls under Sections 13.4, 13.5 and 13.7;
- our obligation to credit confirmed sell-backs and to pay or credit refunds we owe you, including under Section 14.2; and
- anything else that cannot be limited by law.
The cap in (B) does not limit any of these obligations. These Terms never require you to release VelaVia from liability for gross negligence.
New Jersey residents. The exclusions and limits in Sections 27 and 28 do not apply to the extent New Jersey law prohibits them, including for punitive damages, gross negligence and claims under the New Jersey Consumer Fraud Act. All other terms apply.
29. Indemnification
29.1 Your obligation. You agree to indemnify VelaVia LLC and its officers, employees and agents against third-party claims, including reasonable attorneys’ fees, to the extent they arise from your breach of these Terms, your violation of the law or anyone’s rights, or Your Content or items you supplied, traded or sold that infringe someone’s rights, are counterfeit or stolen, or that you misdescribed.
29.2 Exceptions. This does not apply to the extent a claim was caused by VelaVia’s own negligence, fraud or willful misconduct, or concerns an item VelaVia sold or delivered to you, unless it arises from your own alteration or misdescription of that item.
29.3 Defense and settlement. We will tell you promptly about any covered claim. VelaVia controls the defense, and you agree to cooperate reasonably. You may not settle a claim in a way that places obligations on VelaVia without VelaVia’s written consent.
30. Dispute resolution: individual arbitration and class-action waiver
30.1 What this section covers. This section applies to any dispute between you and VelaVia that arises from or relates to RipNova or these Terms (a “Dispute”), including claims against VelaVia’s members, managers, officers, employees and agents that arise from or relate to RipNova. It includes claims against VelaVia’s service providers only if the claim arises from services they performed for VelaVia for RipNova and is brought together with a claim against VelaVia. The persons named in this Section 30.1 may enforce this Section 30 for the claims it covers.
This section applies only after you have accepted these Terms in the App (Section 1.3). It does not apply to a Dispute that was already the subject of a lawsuit or a Dispute Notice before you accepted. If you live outside the United States, it applies to the extent the mandatory law of your country allows.
30.2 Try to resolve it informally first. Before starting arbitration, send a written “Dispute Notice” with your name, your RipNova handle (if any), an email address where we can reach you, a description of the Dispute and the relief you want. Send it to contact@velavia.io with the subject line “RipNova Dispute Notice,” or by mail to the address in Section 35. We will send any Dispute Notice to you by email if we have an address for you, or otherwise in the App. Both sides then have 60 days to resolve the Dispute, and either side may ask for a phone or video call. Time limits for bringing claims are paused during those 60 days. This step must be completed before arbitration can begin.
30.3 Individual arbitration. If the Dispute is not resolved, it will be decided by binding individual arbitration under the Federal Arbitration Act.
- Provider and rules. JAMS runs the arbitration under its Streamlined Arbitration Rules for claims of $250,000 or less, and its Comprehensive Rules for larger claims, with the JAMS Consumer Minimum Standards applying in either case. If JAMS is unavailable, the AAA runs it under its Consumer Arbitration Rules.
- Arbitrator. One arbitrator, who must be a retired judge or a lawyer with at least 10 years of experience.
- Hearings. By video unless the arbitrator decides an in-person hearing is needed. Any in-person hearing takes place in the county where you live. For claims of $10,000 or less, you may choose to have the case decided on written documents alone.
- Award. The arbitrator may award the same individual relief a court could, and will issue a written decision with reasons.
YOU AND VELAVIA GIVE UP THE RIGHT TO A JURY TRIAL FOR DISPUTES DECIDED IN ARBITRATION.
30.4 Exceptions. Either side may:
- (a) bring an individual claim in small-claims court, for as long as it stays there;
- (b) ask a court to order a stop to infringement or misuse of intellectual property; or
- (c) seek public injunctive relief under California law in court. Any such case is paused until the individual claims have been arbitrated.
Nothing in this section prevents you from reporting a matter to a government agency.
30.5 Who decides. The arbitrator decides questions about the scope and enforceability of this section, except that a court decides the validity of the class waiver (30.6), the mass-arbitration procedures (30.8) and whether a claim seeks public injunctive relief.
30.6 CLASS-ACTION WAIVER. YOU AND VELAVIA MAY BRING CLAIMS ONLY ON AN INDIVIDUAL BASIS, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE OR REPRESENTATIVE PROCEEDING.
If this waiver is found unenforceable for a particular claim, that claim alone will be separated and decided in a court identified in Section 31.2, and the court case will be paused until the individual claims have been arbitrated. Class arbitration is never allowed.
30.7 Fees.
- What you pay. No more than the consumer filing fee allowed by the JAMS Consumer Minimum Standards (or the AAA Consumer Arbitration Rules if the AAA runs the arbitration). VelaVia pays all other administrative and arbitrator fees.
- Smaller claims. For claims of $10,000 or less, VelaVia also pays you back your filing fee, unless the arbitrator finds your claim frivolous.
- Attorneys’ fees. Each side pays its own unless the law allows otherwise. VelaVia will not seek its attorneys’ fees from you unless the arbitrator finds your claim frivolous.
30.8 Mass arbitration. These rules apply when the same or coordinated lawyers or organizations bring 100 or more substantially similar Disputes within any 90-day period:
- (a) Each claim still needs its own Dispute Notice.
- (b) Test cases. The claimants’ lawyers choose 10 claims and VelaVia chooses 10. Those 20 go to arbitration first. The others are not filed while they wait, and no fees are due for them.
- (c) Mediation. Within 60 days after the test cases are decided, there is one global mediation with a mediator both sides agree on, paid for by VelaVia.
- (d) Batches. Unresolved claims are then filed in batches of up to 100, which run at the same time. Where JAMS allows, one arbitrator decides each batch, ruling on each claim individually.
- (e) Time limits. Time limits for bringing claims are paused for every claim while it waits its turn.
- (f) Delays. If a claim has not been filed in arbitration within 180 days after its Dispute Notice, and the delay is not the claimant’s fault, the claimant may take that individual claim to court under Section 31.
- (g) Other rules. JAMS’s mass-arbitration procedures apply where consistent with this section. Nothing in this Section 30.8 limits the remedies in California Code of Civil Procedure Sections 1281.97 to 1281.98. A court may enforce this section.
30.9 Opting out. You may opt out of this Section 30 within 30 days after you first accept these Terms in the App. Email contact@velavia.io with the subject line “RipNova Arbitration Opt-Out,” or write to the address in Section 35, with your name, your RipNova handle (if any), an email address where we can reach you, and a statement that you opt out of arbitration. If you opt out, Disputes go to court under Section 31, and the rest of these Terms still apply. Any earlier opt-out you made still applies.
30.10 Changes to this section. We will give 30 days’ notice of any material change to this section. A material change applies to you only after you accept it in the App, for example when you create an account or through an acceptance step we show you. You may also reject the change by emailing contact@velavia.io within those 30 days. If you do not accept, or you reject, the change, the last version of this section you accepted keeps applying to you. A change never applies to a Dispute for which a Dispute Notice was sent before the change took effect.
30.11 Severability. If any part of this section, other than 30.6, is found unenforceable, that part is removed and the rest still applies. If this section as a whole is found unenforceable, Disputes go to court under Section 31. This section continues to apply after your use of RipNova ends.
31. Governing law and venue
31.1 Governing law. California law governs these Terms, without regard to its conflict-of-law rules. The Federal Arbitration Act governs Section 30. This does not take away any protection you have under consumer-protection laws of your state or country of residence that cannot be waived by contract.
31.2 Courts. Any matter that is not arbitrated must be brought only in the state courts of Sacramento County, California, or the U.S. District Court for the Eastern District of California, and you and VelaVia agree that these courts have jurisdiction. You may still bring a small-claims case in the county where you live.
32. Changes to these Terms
32.1 Minor changes. Changes that are not material take effect when we post them.
32.2 Material changes. We will give notice of a material change in the App and on the Site, and by email to anyone whose address we hold. A material change takes effect no sooner than 30 days after that notice, unless the law requires it sooner. If you keep using RipNova after it takes effect, you accept it. Where the law requires your active consent, we will ask you to accept the change before it applies to you. Changes to Section 30 follow Section 30.10.
32.3 Changes look forward only. A change never applies to a claim for which notice was given before the change, or to a purchase, sell-back or shipping request confirmed before it.
32.4 If you disagree. You may stop using RipNova, ask us to ship any Nova Credit pulls you keep, and ask us to delete your account (Section 18.3).
32.5 Versions. Each version of these Terms has a version number shown at the top and listed in Section 36. We keep a copy of every version and will send you any earlier version on request at contact@velavia.io.
33. General terms
33.1 Entire agreement. These Terms, the documents listed in Section 1.5, any Additional Terms and any Official Rules are the whole agreement between you and VelaVia about RipNova. The general VelaVia Terms do not apply to RipNova (Section 1.4).
33.2 Transfer. We may transfer these Terms as part of a merger, acquisition or sale of assets, and we will tell you if we do. Anyone who takes over RipNova must take on our obligations for Nova Credits you bought, Nova Credit pulls and amounts we owe you. You may not transfer these Terms.
33.3 No waiver. If we do not enforce a term, we have not given up the right to enforce it later.
33.4 Invalid terms. Apart from Section 30.11, if any term is found unenforceable, it is limited only as far as necessary, and the rest of these Terms still apply.
33.5 Events outside our control. Neither side is responsible for delays caused by events beyond its reasonable control. Once such an event is over, our duty to ship Nova Credit pulls you asked us to ship continues.
33.6 Relationship. You and VelaVia are independent of each other. These Terms do not create a partnership, employment or agency relationship.
33.7 Third parties. No one else has rights under these Terms, except Apple under Section 25.2, the people indemnified under Section 29, and the persons who may enforce Section 30 under Section 30.1. Rules about how Members deal with each other, such as Sections 9.4 and 9.12, are platform rules that VelaVia enforces. They do not give one Member rights against another under these Terms.
33.8 Interpretation. Headings are for convenience only. If these Terms are translated, the English version controls.
34. Notice to California consumers
Prices for Rip packs, Boxes, shipping and any other fees are shown in the App before you pay.
